1. General information
Donatty.com grants the right to use online the Donatty.com software located on the Internet at the Website (URL): https://donatty.com in accordance with the terms of these Terms of Service.
These Terms of Service, published on the Internet at (URL): https://donatty.com/pages/agreement, are addressed to an indefinite range of persons and set out Donatty.com's intention to grant the right to use the Donatty.com software, its functionality and individual services to any person who accedes to the Terms of Service, solely by acceding to the proposed agreement as a whole.
These Terms of Service therefore constitute a public offer within the meaning of article 437 of the Civil Code of the Russian Federation.
1. General information
Donatty.com grants the right to use online the Donatty.com software located on the Internet at the Website (URL): https://donatty.com in accordance with the terms of these Terms of Service.
These Terms of Service, published on the Internet at (URL): https://donatty.com/pages/agreement, are addressed to an indefinite range of persons and set out Donatty.com's intention to grant the right to use the Donatty.com software, its functionality and individual services to any person who accedes to the Terms of Service, solely by acceding to the proposed agreement as a whole.
These Terms of Service therefore constitute a public offer within the meaning of article 437 of the Civil Code of the Russian Federation.
2. Definitions and terms
2.1 Unless defined otherwise, for the purposes of the Terms of Service the terms listed below have the following meanings:
“Acceptance of the Offer” — full and unconditional acceptance of the Terms of Service by performing the actions set out in article 15 of the Terms of Service. Acceptance of the Terms of Service concludes the Agreement between the User and Donatty.com;
“Internet” — the worldwide system of computer networks providing communication between remote computers and systems using the main transport protocol and data transfer protocol, known respectively as TCP/IP;
“Gift”, “Donation”, “Contribution”, “Sponsorship” or any other combination of these terms — funds, electronic funds or other lawful means of payment given by Internet users to the User in support of them;
“Licensor”, “We”, “Donatty.com” or any other combination of these terms — means DONATTY Limited Liability Company, registered under the law of the Russian Federation at: 424000, Yoshkar-Ola, Uspenskaya St. 11, office 22, PSRN 1191215004496 and TIN 1215229924;
“Licensee”, “You”, “User”, “Streamer”, “Video blogger” or any other combination of these terms — means a legally capable individual, a legally capable sole trader or a legally competent legal entity that has entered into these Terms of Service with Donatty.com by acceding to the proposed Terms of Service as a whole and that acquires, on the basis of the Terms of Service, the right to use the functionality or individual services of the Donatty.com software;
“Personal account” — the client-side part of the Donatty.com Service enabling the User to interact with the Donatty.com Service;
“Terms of Service”, “Offer” or any other combination of these terms — this document, published on the Internet at (URL): https://donatty.com/pages/agreement;
“Agreement” — the agreement between the User and Donatty.com on the terms of the Terms of Service, concluded through Acceptance of the Terms of Service;
“Donatty.com Service”, “Service” — the set of technical, technological and organisational solutions of the Licensor enabling the User to make and receive Donations;
“Operator” — the non-bank credit organisation MONETA (limited liability company), established under the law of the Russian Federation and engaged in transferring funds, including electronic funds, without opening bank accounts. Banking licence No. 3508-K dated 29 November 2017.

“Content” — information in various forms (text, graphics, audio and video files);
“Website” — an information resource on the Internet having a unique resource identifier (hereinafter “URL”, short for Universal Resource Locator) and consisting of a set of interlinked web pages grouped by subject and intended for publishing information on the Internet;
“Web page” — a self-contained component of a website, a separate document on the Internet created using the HTML language, identified by a unique URL and containing information (text, graphics, audio and video files);
“Video content” — a type of Content, a body of information on a particular subject encoded as digital data of moving images and presented as video and sound;
2.2 Other terms and definitions used in the Terms of Service have the meaning of, and are to be interpreted in accordance with:
1) the provisions of the Terms of Service;
2) the meaning of such term as given on the Donatty.com Website;
3) the applicable law of the Russian Federation;
4) applicable international law;
5) established practice in the use of these terms, definitions and phrases on the Internet.

3. Subject matter of the Terms of Service
3.1 Donatty.com grants the User, on the terms of a simple non-exclusive licence, the right to use the Service in the manner established by the Terms of Service.

4. User registration
4.1 To use the Service, the User must complete the registration procedure at (URL): https://donatty.com/
4.2 To register, the User must provide accurate and complete information about themselves in response to the questions in the Service's registration form. Where necessary and upon further request, the User undertakes to provide the Service with the information required to perform the services set out in clause 3.1 of the Terms of Service.
4.3 On completing the registration procedure the User gains access to their Personal account.
4.4 The User's personal information contained in the account of the User's Personal account is stored and processed by Donatty.com in accordance with the Privacy Policy published at (URL): https://donatty.com/pages/privacy.
4.5 The User consents to the processing of their personal data received by Donatty.com for the purpose of concluding the Terms of Service, for a period until the expiry of the retention periods for the relevant information or the documents containing it, in accordance with the applicable law of the Russian Federation or applicable international law.
4.6 By registering on the site, the user also agrees to the payment terms applied to payments made using bank cards and other means of payment through the Operator, and to the Operator's rules of use, published on the Internet at: https://www.moneta.ru/info/d/ru/public/users/nko/cardsserviceoffer.pdf

4.7 The User also consents to the Service passing to the Operator the instructions required to perform the services set out in clause 3.1 of the Terms of Service.
4.8 If the User registers on the site using a Google account, they agree to and undertake to further comply with the YouTube terms of service published on the Internet at https://www.youtube.com/t/terms and the YouTube privacy policy published on the Internet at https://www.youtube.com/t/privacy.
4. User registration

5. The User's personal account. Simple electronic signature
5.1 To access their Personal account the User may use third-party authorisation services, including third-party APIs such as Twitch, YouTube and VK.
5.2 Under no circumstances may the User give third parties access to their Personal account.
5.3 The User is solely responsible for keeping access to their Personal account safe and confidential.
5.3 All actions performed in the User's Personal account are deemed to have been performed by the User personally. The User performs obligations and bears responsibility to third parties for all actions taken using their Personal account independently and at their own expense.
5.4 By registering in the personal account of the Donatty.com service, the user confirms that their simple electronic signature has been created. Any information in electronic form signed with the user's simple electronic signature is recognised by the parties to these terms of service as an electronic document equivalent to a paper document signed by the user's own hand.
5.5 All actions taken by the User in their personal account are deemed instructions signed with a simple electronic signature.
5. The User's personal account. Simple electronic signature
5.1 To access their Personal account the User may use third-party authorisation services, including third-party APIs such as Twitch, YouTube and VK.

6. How the services are performed
6.1 Access to the Donatty.com Service is possible only if the User has access to the Internet. The User obtains and pays for such access independently, on the terms and at the rates of their telecom operator or Internet access provider.
6.2 The Donatty.com Service gives the User the ability, through their Personal account, to:
configure widgets for interacting with their viewers;
configure the appearance of messages published in their Video content;
create hyperlinks for receiving Donations;
send instructions to the Operator;
take other actions in accordance with the Terms of Service.
6.3 Donations are received and funds are withdrawn by the Service passing the User's instruction to the Operator, using bank cards and other means of payment, through the Operator's Internet resource.
6.4 The Service chooses the Operator for receiving donations and withdrawing the User's funds at its own discretion, in performance of this agreement. The Operator chosen by the Service is shown during the payment process.
6. How the services are performed
6.1 Access to the Donatty.com Service is possible only if the User has access to the Internet. The User obtains and pays for such access independently, on the terms and at the rates of their telecom operator or Internet access provider.
6.2 The Donatty.com Service gives the User the ability, through their Personal account, to:
configure widgets for interacting with their viewers;
configure the appearance of messages published in their Video content;
create hyperlinks for receiving Donations;

7. Payment procedure

7.2 Information on the maximum fees and limits charged by the Operator is made available to the User through the Donatty.com website.
7.4. Information on the fees actually paid is shown in the Finance section of the Service.
7.3 The Operator may change the remuneration (fee) for making transfers unilaterally, with prior notice to Users of the Service in the relevant sections of the Service's website.
7.4 The Operator's current rates for servicing individuals when making transfers on donatty.com are published on the Internet at: https://www.moneta.ru/info/d/ru/public/users/nko-documents.htm and https://www.best2pay.net/legal-info/
7. Payment procedure

8. Giveaways
8.1 A giveaway is any game mechanic under which any rewards (material or immaterial) or gifts are distributed among participants who have made a donation.
8.2 A giveaway run using the Service must comply with the laws of the countries of both the recipient and the sender of the donations. Checking such compliance, and liability for breaching those laws before the law and before participants, rests entirely with the User running the giveaway.
8.3 The User running the giveaway must set out the terms of the giveaway clearly and unambiguously on the Web pages where they place the hyperlink for receiving Donations. If a donation does not guarantee a reward, this must be stated in the published terms of the giveaway and on the donation Page in the Service, for example as follows: “A donation does not guarantee a reward.”
8.4 The Service bears no responsibility for the giveaway's compliance with the law, for the User running the giveaway observing its rules, or for any direct or indirect losses incurred by the User, the organiser or the participants of the giveaway, including losses connected with errors in the operation of the Service or its temporary unavailability.

9. Revocation of the licence, suspension of access to the Donatty.com Service and of the provision of services
9.1 Donatty.com has the right to revoke the non-exclusive licence to use the Donatty.com Service and to suspend access to the Donatty.com Service and the provision of the services set out in clause 3.1 of the Terms of Service immediately in the following cases:
if the User fails to observe and breaches the warranties set out in clause 11.2 of the Terms of Service;
if the User fails to observe and breaches the terms set out in section 8 of these Terms of Service;
if the User uses the Service to upload, send, transmit or otherwise post information that is unlawful, harmful, threatening, defamatory, offensive to public morals, infringing of copyright, or that promotes hatred and/or discrimination against people on racial, gender, religious or social grounds, or contains insults directed at specific people or organisations;
if the User uses the Service to upload, send, transmit or otherwise post information that infringes a third party's intellectual property rights;
if the User uses the Service to upload, send, transmit or otherwise post advertising material not specifically permitted, spam (including search spam), lists of other people's email addresses, “pyramid” schemes, multi-level “network” marketing (MLM), online earning systems and email businesses, chain letters, or to take part in such activities;
if the User uses the Service to upload, send, transmit or otherwise post any materials containing viruses or other computer code, files or programs intended to disrupt, destroy or limit the functionality of any computer or telecommunications equipment or software, or to gain unauthorised access, as well as serial numbers for commercial software products and programs for generating them, logins, passwords and other means of gaining unauthorised access to paid resources on the Internet, or to post links to such information;
if the User infringes the rights of minors and/or harms them in any form;
if the User infringes the rights to freedom of conscience and religion;
if the User infringes the rights of minorities;
if the User impersonates another person or a representative of an organisation and/or community without sufficient right to do so, or misleads others as to the properties and characteristics of any subjects or objects;
if the User collects and stores third parties' personal data without their consent;
if the User otherwise breaches the applicable law of the Russian Federation or the norms of international law;
where there are non-standard or unusually complex schemes in the way the Service is used that differ from ordinary market practice, or where transactions are convoluted or unusual in nature and have no obvious economic sense or obvious lawful purpose.
9. Revocation of the licence, suspension of access to the Donatty.com Service and of the provision of services
9.1 Donatty.com has the right to revoke the non-exclusive licence to use the Donatty.com Service and to suspend access to the Donatty.com Service and the provision of the services set out in clause 3.1 of the Terms of Service immediately in the following cases:
if the User fails to observe and breaches the warranties set out in clause 11.2 of the Terms of Service;
if the User fails to observe and breaches the terms set out in section 8 of these Terms of Service;
if the User uses the Service to upload, send, transmit or otherwise post information that is unlawful, harmful, threatening, defamatory, offensive to public morals, infringing of copyright, or that promotes hatred and/or discrimination against people on racial, gender, religious or social grounds, or contains insults directed at specific people or organisations;
if the User uses the Service to upload, send, transmit or otherwise post information that infringes a third party's intellectual property rights;
if the User uses the Service to upload, send, transmit or otherwise post advertising material not specifically permitted, spam (including search spam), lists of other people's email addresses, “pyramid” schemes, multi-level “network” marketing (MLM), online earning systems and email businesses, chain letters, or to take part in such activities;

10. Exclusive rights to the Donatty.com Service
10.1 All objects available through the Service, including design elements, text, graphic images, illustrations, video, computer programs, databases, sounds and other objects (hereinafter — the content of the Donatty.com Service), as well as any Content posted on the Donatty.com Website, are subject to the exclusive rights of the Service, except where such Content has been uploaded by the User themselves in their personal account.
10.2 The Service bears no responsibility for Content posted by the User, but undertakes, upon discovering a violation, to remove uploaded content that breaches the rules set out in clause 9.
10.3 Use of the Content, as well as of any other elements of the Donatty.com Service, is possible only within the functionality of the Donatty.com Service. No elements of the content of the Donatty.com Service, nor any Content posted on the Donatty.com Website, may be used in any other way without the prior written permission of the rights holder.
10. Exclusive rights to the Donatty.com Service

11. Warranties
11.1 The Service warrants to the User:
that Donatty.com holds all lawful rights and powers to enter into the Terms of Service;
that Donatty.com will make every effort to fix any faults and errors in the Donatty.com Service, should they arise, as quickly as possible. Donatty.com does not, however, warrant that the User's use of the Donatty.com Service will be free of errors and faults.
11.2 The User warrants to the Service:
that the User has legal capacity and competence, as well as all lawful rights and powers to enter into the Terms of Service;
that the User will use the Donatty.com Service only to receive gifts and gratuitous transfers of Donations, and will inform their sponsors that they are providing financial support voluntarily, gratuitously, without conditions and at their own discretion;
that the content and form of the Content (including but not limited to the content of Web pages and Websites linked to by the Service software) do not breach and do not lead to a breach of applicable law and/or the rights of third parties;
that the User enters into the Terms of Service voluntarily, and that the User has fully read the terms of the Terms of Service, fully understands the subject matter and terms of the Terms of Service, fully understands the meaning and consequences of their actions with regard to entering into and performing the Terms of Service, and intends to perform its terms.
11. Warranties
11.1 The Service warrants to the User:
that Donatty.com holds all lawful rights and powers to enter into the Terms of Service;
that Donatty.com will make every effort to fix any faults and errors in the Donatty.com Service, should they arise, as quickly as possible. Donatty.com does not, however, warrant that the User's use of the Donatty.com Service will be free of errors and faults.
11.2 The User warrants to the Service:
that the User has legal capacity and competence, as well as all lawful rights and powers to enter into the Terms of Service;
that the User will use the Donatty.com Service only to receive gifts and gratuitous transfers of Donations, and will inform their sponsors that they are providing financial support voluntarily, gratuitously, without conditions and at their own discretion;
that the content and form of the Content (including but not limited to the content of Web pages and Websites linked to by the Service software) do not breach and do not lead to a breach of applicable law and/or the rights of third parties;
that the User enters into the Terms of Service voluntarily, and that the User has fully read the terms of the Terms of Service, fully understands the subject matter and terms of the Terms of Service, fully understands the meaning and consequences of their actions with regard to entering into and performing the Terms of Service, and intends to perform its terms.
12. Liability of the parties and limitation of liability
12.1 The Parties are liable for failure to perform or improper performance of obligations under the Terms of Service in accordance with the applicable law of the Russian Federation, unless the Terms of Service provide otherwise.
12.2 If the User breaches the Terms of Service, Donatty.com has the right to claim compensation in full for the losses it incurs as a result of that breach, and reimbursement of all court costs and other expenses.
12.3 Under no circumstances is Donatty.com liable for:
any acts or omissions that are the direct or indirect result of the acts or omissions of the User and/or third parties;
any indirect losses and/or lost profits of the User and/or third parties, regardless of whether Donatty.com could have foreseen the possibility of such losses;
the use of, inability to use, or any consequences whatsoever of the use of or inability to use the funds transfer method chosen by the User;
content uploaded to the service by the User.

13.3 If disputes between the User and Donatty.com concerning performance of the Terms of Service are not resolved through negotiation between the Parties, they are subject to consideration in the manner prescribed by the applicable law of the Russian Federation in the Arbitration Court of the Republic of Mari El.

15. Acceptance
15.1 These Terms of Service constitute a public offer by Donatty.com and may be accepted by any person solely by acceding to the proposed Terms of Service as a whole.
15.2 The User accepts the Terms of Service by completing the registration procedure and using the personal account of the Donatty.com service.
15.3 The moment the Agreement between the User and the Service is concluded on the terms of these Terms of Service is the moment of the User's first sign-in to their personal account.
15. Acceptance
15.1 These Terms of Service constitute a public offer by Donatty.com and may be accepted by any person solely by acceding to the proposed Terms of Service as a whole.

16. Term of the Terms of Service
16.1 Acceptance of the Terms of Service by the User, performed in accordance with clause 15 of the Terms of Service, creates an Agreement between the User and Donatty.com under article 438 of the Civil Code of the Russian Federation, on the terms of the Terms of Service.
16.2 The Agreement takes effect from the moment the User accepts the Terms of Service and remains in force until the Parties have performed their obligations under the Agreement through the Service providing its services and granting the non-exclusive licence, or until the Agreement is terminated.
16.3 The Agreement may be terminated early at any time by written agreement of the Parties.
16.4 Either Party to the Agreement may terminate it unilaterally, out of court and without giving reasons, provided the other Party is notified in writing fifteen (15) calendar days before the termination date.
16.5 Donatty.com has the right to terminate the Agreement unilaterally, out of court and immediately if the User:
has not signed in to their Personal account for three (3) consecutive months;
has breached the terms of the Terms of Service.
16. Term of the Terms of Service

17.2 The Service notifies the User of amendments to the Terms of Service directly on the Donatty.com Website by publishing new Terms of Service (without any special separate announcement or message), no less than five (5) calendar days before the amendments take effect, unless a different period is specified by Donatty.com in such publication.

18.4 In all other matters not covered by the terms of the Terms of Service and the Agreement, Donatty.com and the User are governed by the applicable law of the Russian Federation, applicable international law and established good-faith business practice on the Internet.
